Take It Down Act: Trump Signs Law to Tackle AI Deepfake and Online Image Abuse

On May 19, US President Donald Trump signed a new law aimed at stopping the spread of intimate photos and videos shared online without consent.

The bill, known as the Take It Down Act, also applies to content created using artificial intelligence (AI).

The bill passed with strong support in both chambers of Congress. The House voted 409-2 in favor, and the Senate passed it without any objections. Lawmakers stated that the law is needed to deal with the growing threat of AI and to close gaps in existing rules about online abuse.

Under the law, anyone who posts or threatens to post private images to cause harm or harassment can be charged with a federal crime. This includes real content shared without permission, as well as AI-generated deepfakes that look real.

Websites, apps, and other platforms that host user-generated content are required to have a clear takedown system. They must remove flagged images and any copies within 48 hours of receiving a report.

The law outlines different standards for adults and minors. For adults, the law covers cases where someone shares a private image without consent, especially when it was taken in a situation where the person expected privacy.

For minors, the law applies when the purpose of sharing is to harass, abuse, or exploit the child in any way. Since children cannot legally consent to such acts, the law sets stricter protections in these cases.
